All information exchanged is kept strictly private and confidential.

HK Law Tutor and David is not responsible for, and expressly disclaims all liability for, damages of any kind arising out of use, reference to, or reliance on any information contain within the site, or for links to third-party sites, their Web site content, products or services. While the information contained within the site is periodically updated, no guarantee is given that the information provided on this site is correct, complete and up-to-date. While HK Law Tutor and David provides knowledgeable and professional tutoring, exam results are dependent on students own efforts and attitude.

TERMS AND CONDITIONS/CANCELLATION POLICY

Private Sessions General

The following terms and conditions form part of every booking and the client is deemed to have accepted and agreed to be bound by these terms and conditions by making a booking with HK Law Tutor (“HK Law Tutor” term includes David).

HK Law Tutor reserves the right to amend these terms and conditions without prior notice.

Throughout this document, the term “Sessions” refers to and includes all chargeable services

including legal tutorials, corporate law consulting, legal career consulting sessions and essay service.

Should any part, clause(s) or sub-clause(s) of this contract be unenforceable, the rest of this contract will remain in force without these parts, clause(s) and sub-clause(s). Any liability on HK Law Tutor’s part will be limited strictly to the clause or sub-clause in which the liability occurs and such liability will have no effect on the remainder of this contract which will otherwise apply in full.

Contractual Parties

The parties to this contract are the client and HK Law Tutor.

Scheduling Sessions

All sessions can be scheduled only through HK Law Tutor and confirmed in writing.

Rescheduling Sessions

When a session or session series is scheduled a tutor is allocated to each session in the series and the time of the allocated tutor(s) is reserved. Therefore the session or session series is not cancellable and no refunds will be made. However sessions may be re-scheduled subject to the following terms.

All requests for re-scheduling must be made to HK Law Tutor by email to us Notice given directly to tutors will not be accepted as notice of re-scheduling.

Notice of intention to reschedule a session must be received by 6pm two working days before the scheduled session. No session will be rescheduled if notice is not received by 6pm two working days


before the scheduled session. In this case the session will go ahead at the original time and will be forfeited if the client does not attend it. (For the avoidance of doubt “working days” means Monday to Saturday inclusive. The only exception is a statutory holiday that falls between Monday to Saturday inclusive, which is not a working day. Sundays are not working days.)

Shortening of the session duration is not permitted. The student may leave the session early but there will be no refund.

Lengthening of the session is permitted, subject to the availability of a suitable tutor.

In the event that a session re-scheduling is necessary due to illness, such session(s) may be re- scheduled to a mutually agreeable time free of charge provided that reasonable notice is given where possible, that the re-scheduled session takes place within one month of the originally scheduled session.

Any re-scheduling must be done in accordance with clauses 8 and 9 above. If not, all such session(s) will be forfeited and the client agrees that no refunds will be given.

Cancellation/Non-attendance

In the event of a student failing to appear online on Skype for a confirmed session after 20 minutes with no notice, the session will be treated as a ‘no-show’ and will be forfeited with no refund or rescheduling. However, if the student or their representatives advises HK Law Tutor that they will be late within 20 minutes after the session start time, the session will take place from five minutes after the student appears online on Skype until the original time at which the session was scheduled to finish.

Cancellation and/or non-attendance online on Skype for of a session will forfeit the full cost of the session. No refund will be provided.

Payment

The client agrees that liability for payment is incurred and becomes binding on the client upon confirmation of the session schedule, at which point the entire amount for all sessions in the schedule is due.

If payment has not been made in advance of the first session, the client’s liability for payment remains even if the student does not attend the first or any subsequent sessions. Under these circumstances payment should be made as soon as possible to avoid a late payment fee.

Payment may be made directly into one of HK Law Tutor’s authorized bank accounts or PayPal Account,

details of which will be included on the invoice and are available upon request.

Payment of the full invoice for all the sessions booked must be made before the start of the first session to which the payment applies. If payment of the full amount of the invoice is not received in advance of the start of the first session for which the payment applies, the payment will be deemed late. HK Law Tutor reserves the right to suspend sessions where there is an overdue payment until the outstanding balance has been cleared. Any such sessions which are suspended will be forfeited without refund.

The client understands and agrees that HK Law Tutor has spent considerable time, effort and expense to be in a position to provide the services contracted. Once the client has booked sessions with HK Law Tutor, the charge for those sessions is fully due and once paid to HK Law Tutor, is not refundable in part or in full. The client understands and agrees that in the event the client does not proceed with any of the contracted sessions, the full amount of any outstanding payment for such sessions remains due, and


clauses 16 to 19 remain in force. Further, any sums paid by the client to HK Law Tutor may be retained and any sums owed by the client to HK Law Tutor will be paid to HK Law Tutor as liquidated damages for compensation resulting from client’s failure to complete all sessions contracted.

Special Promotions, discounts and waivers

From time to time, limited availability promotions or discounts may apply. For such promotions full payment must be received before the sessions are booked and the tutors’ time is reserved. The payment is non-cancellable and non-refundable. Session shortening is not permitted. The new time and date of the rescheduled session must be received before the time of the original session. If the rescheduled date and time is not agreed upon, before the original date of the session, that session will not be re-scheduled and will be forfeited if the client does not appear for the session as originally scheduled. Special Promotions cannot be combined with other discounts, promotions or waivers. The client understands that in order to provide promotional rates there may be changes of tutor during the promotional session series, to which the client agrees.

Session Conduct

Students should appear online on Skype no later than five minutes before the scheduled start of their sessions in order for sessions to start on time. For students arriving less than five minutes before the start of a session, the session will begin as soon as practicably possible.

Students and clients agree to behave politely and respectfully towards all HK Law Tutor’s representatives including staff and tutors at all times. If students and/or clients verbally or otherwise abuse HK Law Tutor’s representatives, HK Law Tutor reserves the right to suspend and/or terminate sessions without refund.

Small Group Sessions/Special Programmes

Payment may be made by bank transfer or PayPal a minimum of 48 hours in advance of the first class.

CANCELLATION POLICY

All payments are strictly non-refundable. In the event that a student is unable to attend a class 50% of the pro-rated cost of the entire duration of the class may be credited towards a private one-on-one make-up session. Notification of non-attendance must be received by 6 pm two days before the session.

If a student fails to attend a class without notice and if no explanation is received at least 48 hours in advance of the next class, it will be assumed that the student has cancelled all further classes. Under these circumstances, HK Law Tutor has no obligation to provide the class.

Limited Liability

Except as expressly provided in this agreement, HK Law Tutor makes no guarantee or warranties, express or implied. In no event will the HK Law Tutor be liable to the student for consequential or special damages.

Notwithstanding any damages that the student may incur, HK Law Tutor 's entire liability under this agreement, and the students exclusive remedy, will be limited to the amount paid by the student to HK Law Tutor under this agreement for all services rendered up until the termination date.

Entire Agreement Clause

The parties agree that these Terms and Conditions represent the entire agreement between the parties and that any implied terms whether by statute, common law, custom, trade usage, course of


dealings or otherwise in respect of any services to be provided by HK Law Tutor under this Contract are excluded to the fullest extent permitted by law.

Any material amendments to the terms after the date of this document must be made and confirmed in writing by the parties. Specifically, this applies to rescheduling sessions and the related service charge, as well as any other alterations. Any oral alterations to the terms herein are not valid unless in writing and acknowledged by both parties.

If any individual Clause or sub-Clause is rendered void, the rest of the terms and conditions remain fully in effect.

In the case of any dispute, the decision of HK Law Tutor is final.

JURISDICTION

Any dispute between HK Law Tutor and its clients is subject to the law and jurisdiction of Hong Kong.
